Power rebate scam: Fate of Mauvin to be decided on July 16

MARGAO

The fate of Minister Mauvin Godinho, who has filed an application for discharge in the alleged Power rebate scam, will be decided by the South Goa Sessions Court on July 16.

Tuesday saw the prosecution producing the police case diary and other relevant documents before Additional Sessions Judge, Vincent D’Silva.

The lawyer appearing for Mauvin, Adv Arun De Sa had at the last date of hearing filed an application with a plea to direct the investigating agency to produce the police case diary before the court.

The application was apparently filed to show that the police had carried out a re-investigation in the case and not further investigations directed by the Judicial Magistrate First Class, Panaji.

After the Public Prosecutor Adv D Korgaonkar produced the police case diary, Judge Vincent posted the matter for hearing on July 16, wherein the Judge will pronounce the order on Mauvin’s plea for a discharge in the case.

The Judge is also expected to give his order on the application filed by former Chief Electrical Engineer, T Nagarajan seeking his discharge in the case on the plea that no sanction was obtained by the investigating agency before initiating proceedings against him.

The former power minister has moved the court with the application for discharge on grounds that the investigating agency had carried out re-investigations in the case instead of further investigations. It was pointed out by his lawyer that only the Supreme Court and the High Court have the power to order a re-investigation in a case.

The prosecution, however, had strongly opposed Mauvin’s application saying the investigation had conducted further investigation and not re-investigation of the case.
