The State Government has notified the Goa Grant of Comunidade Land for Public Purpose Rules, 2026, laying down a detailed procedure for government departments and agencies to obtain Comunidade land for public projects.
Under the new rules, any Government department, undertaking, institution or statutory body requiring Comunidade land for a government project or any other public purpose will have to submit a detailed proposal to the Administrator of Comunidade.
The proposal will have to specify the nature and justification of the public project, extent of land required reasons for selecting Comunidade land among other requirement.
Departments will also have to furnish details of the existing land use under the Regional Plan, approvals and clearances obtained or proposed to be obtained, lease period, proposed construction, project timeline, administrative approval and the terms and conditions sought.
The Administrator of Comunidade will conduct a preliminary scrutiny of the application and arrange an inspection of the land. Once satisfied with the proposal, the Administrator will forward it to the concerned Comunidade for its consent within 30 days of receiving the application.
The concerned Comunidade will treat the proposal as a special case and place it before its General Body for consideration. The Comunidade will have to communicate its decision to the Administrator within 30 days of the meeting. While granting consent, it will also determine the lease rent for the grant of land on long lease, taking into account the nature of the public purpose, location, extent and value of the land and other relevant factors.
Importantly, the rules stipulate that the minimum land rates notified by the government under the Goa Stamp (Determination of True Market Value of Property) Rules, 2003, will serve as a guiding factor while determining the lease rent.
Once the Comunidade gives its consent, the Administrator to the Director of Civil Administration within four days of receiving the intimation, who will intern scrutinise the proposal and forward it, along with recommendations, to the revenue department as the final decision will rest with the government. The rules further provide that after approval, a lease deed will be executed between the concerned Government department, undertaking, institution or statutory body and the respective Comunidade.
