SANGUEM
The Sanguem JMFC Anusha Kaisukar convicted one Dadapir Mulla of Shirvoi-Quepem for offences under Section 279 and 338 of IPC, in connection with a road mishap.
The incident was reported at Barazan-Sanguem in May 2020 wherein the accused Dadapir Mulla, while proceeding from Barazan towards Valkini Sanguem on a motorcycle, dashed his motorcycle against a pedestrian Vishal Gosavi of Barazan. He suffered grievous injuries to both his legs.
After going through the evidence led by the State through APP Sanford Fernandes, the JMFC found Dadapir Mulla guilty of the offence and convicted him for offences under Sections 279 and 338 of IPC. The court in its order, directed Mulla to pay a fine of Rs 1,000 under Section 279 and in default to under 3 months simple imprisonment and to pay a fine of Rs 8,000 under section 338 and in default to undergo imprisonment for a period of three months. The fine amount of Rs 8,000 if recovered is to be paid to the victim Vishal Gosavi, ordered JMFC.
Mulla was, however, given benefit of Section 3 and 4 of Probation of Offenders Act as far as substances sentences were concerned and was, accordingly, directed to furnish a personal bond of Rs 10,000 to maintain peace and good behaviour for a period of six months. Besides, Mulla was also directed to furnish personal bond with one surety under Section 437 A of IPC.
The prosecution has examined three witnesses in the matter including the Investigating Officer and the victim, Vishal Gosavi.
