The South Goa Sessions Court has framed criminal charges against the six accused persons in the Sheikh Anwar attempt to murder case.
Two of the accused have been discharged by the Court.
The six accused persons, who will face trial in the court, includes Ricky Hornekar (28 ) Pontemol, Curchorem, Imran Bepari, (32) St Cruz, Kalaphur, Tiswadi, Harshavardhan Sawal, (37)
Waiginwada, Bardez, Sudan Da Costa, (40) Seraulim and Vasant Amir Gavande, (38) Near Peace Valley, Shirvoi, Quepem and Vally George Da Costa,(31) Tilamol, Quepem.
Vijay Karbotkar, (31) Coelho wado, Brittona, Bardez and Mahendra Tanawde (37), 20 Point Program, Porvorim, have been discharged in the case.
While all the six accused persons have been charged under sections 143, 147, 148, 307 and 120-B r/w 149 IPC, accused Vally will face the charge under the Arms Act.
In his order framing the charge, Judge Vincent D’Silva said “discernibly, the materials on record including the complaint, statement of witnesses and memorandum of test identification parade and the documents including the arrest cum attachment panchanama, the hurt certificate and the photographs clearly indicate involvement of the accused of hatching criminal conspiracy on February 16 at 13.00 hrs at Arlem Junction and with their common object formed unlawful assembly, armed with deadly weapons like danda, steel pipe, koita etc. with an intent to commit the murder of the complainant”.
The Judge said that charges under Sections 143, 147, 148, 307, 120-B r/w 149 IPC is required to be framed against accused Ricky Hornekar, Imran Bepari, Harshavardhan Sawal, Sudan Da Costa and Vasant @ Amir Gavande. Accused Vally George Da Costa was also found in his possession a firearm without holding a licence issued in accordance with the provisions of the Arms Act, 1958, besides commission of above-referred offence and therefore he shall be charged under Sections 143, 147, 148, 307, 120-B r/w 149 IPC and Section 3 r/w 25 of the Arms Act.
