Shrimat Shivananda Saraswati Swami of Kavale Math has approached the High Court of Bombay at Goa, seeking the cancellation of an FIR registered against him by the Ponda police.
Swami along with Avadhut Shivram Kakodkar and advocate Manohar Adpaikar, have been booked on charges of impersonation, forgery and fraudulent sale of property in Kavale-Ponda.
The case is based on a complaint filed by surgeon Dr P S Ramani and another, who alleged that Shrimat Swami created fake documents regarding the Math's property rights.
According to the complaint, Shrimat Swami allegedly misrepresented himself as the former Swami of the Math and granted a power of attorney to Avadhut Kakodkar. Using these documents, land owned by the Math in Kavale was reportedly sold to the Maharshi Adhyatma Vishwa Vidyalaya.
The complainant further stated that while Swamiji is the Mathadhipati (head of the Math), he is not a trustee and only the Trust has the authority to conduct transactions related to land and other properties.
Seeking to quash the FIR, Shrimat Swami has now filed a writ petition. The High Court on Wednesday issued notices to the respondents including the Ponda police and adjourned the matter to February 26.
