In a six-year-old case, a Motor Accident Claims Tribunal (MACT) has issued an order directing that compensation of around Rs 1.30 crore be made to the two children of a 55-year-old man who lost his life in an accident in 2017.
According to the case details, Anil Kulkarni was en route from Borim to Bethoda around 6:55 pm when, upon reaching Bond Bag, an Ashok Leyland Cargo truck with the registration number KA-25-B-2220, approached from the opposite direction at a high speed, driving recklessly and negligently.
The truck veered onto the wrong side of the road, colliding with the Swift car driven by the deceased, leading to his untimely demise.
His two children, aged 28 and 23 years at the time, filed an application seeking compensation in the amount of Rs 1,53,87,472. The case named VRL Logistics Ltd, a Bangalore-based company that owned the truck, its driver Mahantesh Pampanavar, and an insurance company New India Assurance Company Ltd as respondents.
During the hearing, the representative of VRL Logistics Ltd contested the claim and also denied the allegations of reckless and negligent driving.
After careful consideration of both parties’ arguments, MACT member Cholu Gauns decreed that the claimant was entitled to receive Rs 1,30,97,616 as compensation, along with an annual interest rate of 7 percent on the total compensation amount, starting from the date of the claim petition until the payment or deposit of the awarded sum.
