The Directorate of Transport on Wednesday made final the notification stating that motor vehicles involved in accidents that are not covered by third party insurance would not be returned to the owners, but be auctioned publicly after three months of the vehicle being in the possession of the investigating police officer.
“The motor vehicle shall be sold off in a public auction by the Magistrate having jurisdiction over the area where the accident (has) occurred, on expiry of three months of the vehicle being taken into possession by the investigating police officer,” reads the notification issued by the Director of Transport Nikhil Dessai.
The proceeds of the auction will be deposited with the Claims Tribunal of the area in 15 days. This money will then be used in compensation to be awarded in any claims arising out of such an accident.
The type of accident referred to in the notification is an accident that results in death, bodily injury, and damage to property where the vehicle responsible is not covered by insurance against third party risks. The registered owner needs to be able to furnish a copy of the said insurance when asked for by the investigating officer. The registered owner needs to be able to show sufficient security with which he will be able to pay any claim that is made. The court will decide what is “sufficient security.” In the absence of “sufficient security”, the court will not release the vehicle.
The notification is issued under the Goa Motor Vehicles (Amendment) Rules 2018. A draft notification explaining the same was released in the Official Gazette on October 19, and citizens were asked to submit any objections within 15 days of publication. However, since the Directorate of Transport received no objections or suggestions, the notification has been finalised.
