Speaking to media persons, Halwai also admitted that the Chief Secretary, who is supposedly probing the case, is yet to contact him.
“I am now compelled to file a petition before the Special Court in accordance with section 156(3) of the Code of Criminal Procedure, I appeal to the Chief Secretary of the Government of Goa to immediately place Sunil Garg IGP under suspension in the interest of natural justice and order for immediate registration of an FIR against IGP,” Halwai said.
He said that the ACB has so far failed to act on his complaint despite more than two weeks since his complaint was first filed. “Within in the next two or three days depending on when the paperwork is complete, I will file a case,” Halwai said.
To the allegation that even the bribe giver is guilty in the case of corruption, Halwai pointed to Section 24 of the Prevention of Corruption Act, 1988 which protects a bribe giver from prosecution.
“Notwithstanding anything contained in any law for the time being in force, a statement made by a person in any proceeding against a public servant for an offence under sections 7 to 11 or under section 13 or section 15, that he offered or agreed to offer any gratification (other than legal remuneration) or any valuable thing to the public servant, shall not subject such person to a prosecution under Section 12,” the section reads.
When asked whether the Chief Secretary, who is the chief vigilance officer, and whom the Chief Minister has ordered to probe the case, has contacted him, Halwai has responded in the negative.
