The Sessions Court has directed the framing of charges under the Disability Act and the Indian Penal Code against three locals -- Ruby Rodrigues, Gasper Rodrigues, and Elcy Rodrigues, in connection with a complaint alleging the trio assaulted a woman and her disabled husband.
The Ponda police had registered a First Information Report based on a complaint filed by Senovi Fernandes alleging the accused trespassed into her house and verbally abused her and her husband, Camilo, in filthy language. The accused are also charged with assaulting the complainant and her wheelchair-bound husband.
In a charge sheet filed recently, the police stated that a medical certificate confirmed the grievous hurt on the husband while also submitting required proof for offences under sections 504 (intentional insult), 447 (criminal trespass) and 325 (voluntarily causing grievous hurt) read with 34 (common intention) of the Indian Penal Code.
“The relevance of Section 92 of the Rights of Persons with Disabilities Act, 2016 is evident, as the assault targeted a person with a disability who was confined to a wheelchair,” the charge sheet stated.
Observing the circumstances, Sessions Judge Sherin Paul ordered that charges should be framed against the accused for the offences.
