Kapil Sibal is absolutely spot on when he says why eight Congress MLA’s can’t claim to be real Congress Party if Eknath Shinde group of Shiv sena can demand to be real Shiv Sena looks to be a realistic looking at the overall picture of both the cases and if it is not allowed then the only difference one can imagine is that Shiv Sena is a regional party and Congress a national party but the same rule should apply to both whether regional or national party.
He also argued that merely claiming a majority within the legislative wing, a group cannot claim to be real political party and throw out office bearers elected by the political party is absolutely wrong, unconstitutional the founding members and the bye laws of the party should have a say in declaring which party is real or not.
This type of backdoor entry by gaining a majority from the official group and claiming to be real Shiv Sena party, the Election Commission of India has given a favourable verdict for the Eknath Shinde group consisting of more MLAs than the late Balasaheb Thackrey-founded political party. Also, the bow and arrow has set a wrong precedent to the politicians and will encourage more defections to topple various elected governments by the people hence pose a real threat to democracy.
