The Bombay High Court at Goa has postponed the hearing of the application filed by the Goa government challenging the judicial custody granted to Dattaprasad Gaonkar, the room boy at the Grand Leoney Resort, who allegedly supplied the drugs to Sudhir Sangwan and Sukhwinder Singh, Ramadas Mandrekar and Edwin Nunes, accused in the alleged murder of BJP leader Sonali Phogat.
When the matter came up for hearing the Court was informed that the bail applications that the trio have filed was being heard later in the day (Tuesday) prompting the Court to decide it was better to wait for the trial court’s order before proceeding further.
“Needless to observe that all contentions of the State as permissible in law, are kept open to be urged before the Special Court including liberty to move an application for remand. On any such application to be filed by the State, the contentions of respondents are also left open,” the High Court ruled.
The prosecution had challenged the decision to remand the trio accused to judicial custody, denying them police custody as sought by the police, who argued that their custody could reveal a larger operation at play.
The High Court is now likely to hear the application only once the order on bail is pronounced by the lower court, that is scheduled to be pronounced on Wednesday.
