The submission was made before the Bombay High Court at Goa on Tuesday when the case came up for hearing with the respondents contending that the High Court cannot pass any judgement on disqualification petition filed before it, for the duration that the case is pending before the office of the speaker.
While Gaonkar filed his petition last week, it was revealed only today after the submission was made before the High Court.
Gaonkar, has said that Rane needs to be disqualified as he defied a party whip by abstaining from voting in the motion of confidence in the government.
While the Speaker has issued notices and has expected to hear the matter this week, the case in the High Court will next be heard next Tuesday, where in the Congress will reply to the submissions of the respondents.
Earlier on June 20, the High Court had admitted the petition filed by the Congress and asked that the Election Commission notify the court if it was announcing election dates.
