RGP leader Ajay Kholkar has filed a disqualification plea against Chimbel Sarpanch for persistent remiss in discharging his duties.
In the petition, filed before the Director of Panchayats, Kholkar has pointed out that the panchayat issued demolition order to an illegal structure on February 9 this year granting time of 30 days for the owner/occupier to demolish the same.
“However, despite the completion of 30 days, the said structure was not demolished but instead the panchayat sent me a letter on April 12 stating that the demolition order has been kept in abeyance,” Kholkar informed reporters while stating that the reason given was a letter from an unknown person stating that the property is in dispute.
“The demolition order was not challenged by the said person and as such the panchayat does not have powers to keep the demolition in abeyance as per Section 66 of the Goa Panchayat Raj Act,” Kholkar further opined while stating that it amounts to abuse of powers by the sarpanch.
“Further, the failure to demolish the structure amounts to remiss in the performance of the duties by the panchayat,” Kholkar further added.
“Therefore, the sarpanch is liable to be disqualified under Section 50 (4) for village panchayat Chimbel for being persistently remiss in the discharge of his duties or misconducting himself or misuses or abuses the powers or exercising the powers not expressly vested in him by or under the Act or the rules framed thereunder,” Kholkar states in his petition.
Kholkar has also filed a similar complaint with the DoP against the panchayat secretary.
He has also failed complaint with the Vigilance Department against the sarpanch and the panchayat secretary for failing to execute demolition orders.
