Clear legacy dump, identify a spot within Sonsodo: HC

The Bombay High Court at Goa directed the concerned officials to identify a site measuring 5,000 to 6,000 square metres within the Sonsodo garbage dump to be handed over to a contractor who will be involved in removing the ‘legacy dump’ at the site.   

When the matter came up for hearing, the Bombay High Court at Goa noted that the Margao Municipal Council was only making excuses instead of complying with the orders.   

Although the title of the affidavit is “Compliance Affidavit”, we find that the affidavit only contains some reasons for non-compliance. As noted in our earlier order, it was represented to us that an area of about 5000 to 6000 sq mtrs of land is required, that too, for a limited period, for the purpose of effective execution of contract for removal of the legacy dump which is proposed to be awarded to the contractor. We are sorry to note that the MMC, the officials of the State Government and the officials of the Goa State Pollution Control Board (GSPCB) are unable to identify the site. The affidavit only refers to about three sites and points out how those sites are not suitable for this purpose,” the High Court noted.   

However the MMC lawyer pointed out that such site is available, however, there are some restraint orders in proceedings taken up by Sociedade de Fomento Industrial Pvt Ltd.   

The High Court then directed officials to to go to the site and identify an area of 5000 to 6000 sq mtrs from out of the area of about 20,000 sq mtrs or thereabouts which is stated to have been allotted to Sociedade de Fomento Industrial Pvt Ltd.   

“We make it clear that such site will have to be identified because this issue of clearance of legacy dump has reached alarming proportion and if, this legacy dump is not cleared at the earliest, the same will pose a very serious health hazard,” the HC noted.   
The High Court directed that the inspection be held on Wednesday itself and kept the matter for hearing on Thursday.
