A Mapusa court on Friday adjourned to September 6 the hearing on a petition by Edwin Nunes seeking bail in the case relating to drugs found in the Curlies shack cum restaurant in Anjuna, even as the district judge expressed unhappiness over the procedural lapses by the Investigating Officer.
Nunes was arrested last Saturday after methamphetamine was seized from a toilet of the Anjuna shack cum restaurant.
Even as the bail application of accused Nunes was slotted before the district judge-I on Friday evening, Anjuna Police produced the accused before the judge of another court for remand in the first half of the day which remanded the accused to another seven days judicial custody.
“Remand and bail should be decided by the same judge to avoid conflicting orders. The IO should know the procedure. It is setting a wrong precedent,” said Sharmila Patel, district judge-I in a Mapusa court, when the bail application came up for hearing before her.
The judge also questioned the prosecution for failing to provide the police say in the matter.
Senior counsel Surendra Desai appeared for the accused Edwin Nunes.
Along with Nunes, Anjuna Police had arrested drug peddler Dattaprasad Goankar and Ramdas Mandrekar five days back in connection with the the murder case of BJP leader and Tik Tok star Sonali Phogat.
Phogat was brought dead to a hospital in Anjuna early August 23 after partying with her two associates at the Curlies shack cum restaurant the previous night.
Police have registered two cases in the Phogat murder case “ a murder case and a narcotics case.
Police so far arrested five people in connection with the case including two of her associates “ Sudhir Sagwan and Sukhwinder Singh.
While an officer of DySP level is presently handling the case, initially, Anjuna PI, Prashal Desai was the investigating officer in the case.
