The Bombay High Court at Goa has granted bail to one Mahendra Tanavade who was arrested in connection with the attempt to murder case registered by the Fatorda Police in which Anwar Shaikh was allegedly assaulted.
Tanavade told the court that there was no evidence to link him with the alleged conspiracy to attempt to murder Shaikh as was being alleged by the Fatorda Police and that the other sections he was booked under were bailable.
“Mainly, the allegations against the applicant-accused are harbouring he criminals and criminal conspiracy. The fact remains that during the investigations the physical presence of the applicant at the time of the commission of the offence cannot be, prima facie, inferred from the investigation papers,” High Court single judge bench of Justice Nitin Sambre ruled.
“As far as the offence under Section 212 of IPC is concerned i.e. harbouring the criminals, the same is bailable. As far as the offence under Section 120-B of IPC is concerned, at this stage, there is hardly any material worth consideration. Only a CD-R report, so as to infer the involvement of the applicant at the time of commission of crime, cannot be relied on. The custodial interrogation of the applicant is already over. There are no criminal antecedents,” the Court ruled while proceeding to grant bail on furnishing of a bond of Rs 25,000 and other conditions including to cooperate with the investigation, to report to the police station, not to tamper with evidence, intimidate witnesses, etc.
