GCCI says reversing Section 39A clearances could dent confidence of investors

Amid mounting pressure on the government to repeal Section 39A of the Town and Country Planning (TCP) Act dealing with zone changes, the apex industrial body – Goa Chamber of Commerce and Industries (GCCI) has cautioned that any rollback of legally granted approvals could undermine investor confidence and create uncertainty in the State’s policy environment.
In a press note, GCCI Director Sanjay Amonkar stressed that the chamber’s position is not about supporting or opposing any individual project, but about safeguarding the sanctity of due process. “Approvals granted after scrutiny under the law form basis on which businesses commit capital, secure financing, generate employment, and contribute to the economy,” it said.
“If clearances granted through established legal procedures are later withdrawn or rendered uncertain after investments have already been made in good faith, it sends a signal of inconsistency. Such backtracking can adversely affect investor confidence and make businesses reluctant to invest in Goa,” it said further.
Taking serious exception to the disruption of the functioning of the Town and Country Planning Department (TCP) by an elected representative, GCCI, supporting the stand taken by the CM, said that such behaviour could set a disturbing precedent in public life. GCCI said that the government departments must function without disruption, underlining that administrative continuity and the safety of officials are essential to maintaining public and investor confidence. “Unauthorised occupation of a Government Office intimidation of Officers on Duty and Actions may compromise security and confidentiality of official records and may raise serious concern,” GCCI said.
“Predictability in governance is essential for sustained investment, employment generation, and economic stability. Due process must remain non-negotiable,” it added.
While acknowledging that citizen concerns on environmental or policy matters are legitimate and must be respected, GCCI urged that all challenges be pursued through judicial and legislative forums as provided under law.
Villagers from Palem-Siridao staged a major sit-in protest at the Town and Country Planning (TCP) office last week. The agitation, led by MLA Viresh Borkar, continued overnight, with protesters remaining inside the premises and disrupting official functioning. Police later intervened and cleared the office, escorting the protesters out of the building.
