Directing the Anjuna Police station in-charge to file an FIR against PI Paresh Naik, a Judicial Magistrate First Class court, Mapusa, found merits in the applicant’s petition that the PI had failed to promptly register a complaint and therefore failed to carry out his duty as a conscientious public servant.
The incident dates back to 2014 when Paresh Naik was the police inspector of Anjuna.
Applicant, Nilesh Dabholkar, in his petition informed the court that he had filed a complaint against alleged accused Ramkrishna Pednekar and three others for trespass, abuse and issuing threats on November 21, 2014.
The applicant also said he was a tenant in a property in Anjuna for which he had initiated appropriate legal proceedings under the tenancy act. The accused wanted to evict him from the place, he added.
Instead of promptly registering an FIR, Dabholkar said the PI deliberately delayed the matter and registered it after six days allowing the alleged accused to get bail.
He said the alleged accused managed to get an anticipatory bail due to the lapse of the PI.
He further said during the bail period, the PI failed to quiz the alleged accused and allowed the case to drag on.
“The PI failed to testify eyewitnesses and investigate into the matter properly and finally decided to close the
case as ‘A summary’,” Dabholkar said.
Public Prosecutor, Anuradha Talaulikar, submitted to the court that Anjuna Police in its investigation had found that the applicant did not have proper ownership documents to claim that he was a tenant of the property.
The PP further said no eyewitnesses had also come forward to testify in the case.
Unhappy with the investigation, Dabholkar on February 29, 2016, lodged a complaint against PI, Paresh Naik at the Anjuna Police Station and SP North.
When both the authorities failed to take action against his complaint, Dabholkar filed a case at Mapusa JMFC.
In her order, JMFC Judge, Shantashri Kudchadkar, has directed Anjuna Police to register a complaint against PI Paresh Naik and submit the report to her within 30 days.
