Old Goa controversial structure: Addl DoP stays revocation order of Old Goa panchayat

Granting relief to the owner of the controversial structure in Old Goa, the additional Director of Panchayats (DoP) stayed the revocation order of the Se Old Goa panchayat till the matter is heard and decided.

The stay was granted when the appeal of Corvus Urban Infrastructures LLP came up for hearing on Friday in the court of the additional DoP Umakant Korkankar.

Korkankar also granted time to caveator Save Old Goa Action Committee (SOGAC) to file a proper intervention plea in the matter. The next date of hearing is scheduled for April 5.

Speaking to reporters, Korkankar informed that since the appellant has filed an appeal, it is natural that he be granted relief and hence, a stay has been granted.

“The court will decide whether the panchayat order is right or wrong. At present, there are only two parties involved, which is the appellant and the respondent i.e. the panchayat, and a third party SOGAC is trying to intervene in the matter,” Korkankar informed.

“The caveator SOGAC has asked for time to file application to intervene in the matter as the same has not been made. The time was granted and the next hearing is fixed for April 5,” he stated while adding that SOGAC had filed application as a caveator.

“However, whether SOGAC should be allowed to intervene will be decided by the court after the application is filed and heard,” Korkankar stated while replying to a question.

“The appellant has objected to the caveat filed by SOGAC as according to law, the caveator has to serve notice to the appellant also, which the appellant says has not been done. If the appellant is not served, then the caveator becomes defunct,” he added.

Meanwhile, legal counsel for SOGAC V Korgaonkar informed that the court has granted time to file application for proper impleadment.

“We will file the proper impleading application and bring it to the notice of the court all the illegalities committed by the appellant,” Korgaonkar added.
