While Principal Sessions Judge Desmond D’Costa convicted Rajesh Mishra for killing Rupesh Mishra, a native of Jharkhand, the court has acquitted the remaining two accused Pravesh Kumar Mishra and Sudarshan Mishra of murder.
In his order, Judge Desmond observed that he found that all circumstances proved are consistent with the guilt of accused Rajesh Mishra, adding that they form a complete chain connecting the accused with the murder of the deceased.
The Judge, however, observed that there’s no chain of circumstances established to bring out conclusively the involvement of accused Pravesh Kumar Mishra and Sudarshan Mishra in the crime. “The fact that the duo were residing with accused Rajesh Mishra and the fact that both Pravesh and Sudharshan had injuries as on January 20, 2011 are not grounds for linking them with the present crime, in the absence of cogent evidence bringing out the role in the murder of the deceased,” the judge said, adding “neither the last seen theory nor the motive nor the recoveries nor any extra-judicial confessions have been proved against accused Pravesh and Sudarshan.”
In this case, the Verna police headed by then PI Jivba Dalvi had charged the three accused persons for the murder of Rupesh Mishra, a native of Jharkhand by stabbing him with sharp knives on his neck and other parts of the body. The trio were further accused for dragging the dead body from the incident spot at a distance of 76.20 meters and dumping it in a stone quarry so as to destroy evidence.
