Woman convicted of cheating bank in Sanguem

Arya, husband sold part of mortgaged land after getting loan

SANGUEM

The Judicial Magistrate First Class at Sanguem on Friday convicted one Seema Gyan Arya on charges of cheating a nationalised bank at Sanguem, after the bank had tendered a loan for Rs 12 lakh to Seema Arya and her husband Gyan Arya.

The Arya couple had obtained the loan in 2013 by mortgaging a plot of land owned by them at Undorna Village in Quepem.

However, after having obtained the loan, the Arya couple were allegedly found irregular in making the repayment, compelling the bankers to initiate recovery proceedings.

During the recovery proceedings, the bankers received a notice from a local advocate claiming his client had purchased two plots of land which the Arya couple had mortgaged with the bank.

Upon inquiries, it was revealed that Seema Arya and her husband Gyan Arya had allegedly sold a portion of land after having obtained the loan, with the sole intention to cheat the bankers.

The bank then filed a police complaint against Gyan Arya and Seema Arya under Section 420 of IPC at Sanguem Police Station.

Based on material evidence on record, the police later filed a charge sheet before the JMFC Sanguem.

The court after going through the evidence placed on record by the prosecution led by APP Sanford Fernandes held the accused guilty as the duo had prima facie intentionally sold a portion of the land even after having mortgaged the property with the bank.

Incidentally, during the course of the proceedings, Gyan Arya passed away and the case was proceeded against the co-borrower Seema Arya.

The matter was argued by APP in support of the bank, based on which the JMFC Sanguem convicted Arya for offence under Section 420 and fined her Rs 10,000 to be paid to the bank as compensation and further directed to sit in the court till rising of the court.
