Workers union challenges ESMA in High Court

The Bharatiya Kamgar Sena has challenged the Home Department’s notification invoking the Goa Essential Services Maintenance Act on the sectors of manufacturing, packaging, distribution and transportation of pharmaceutical products, before the High Court of Bombay at Goa.

The petitioner stated that the State government did not consider written objections by the union on the notifications issued at different intervals.

It stated that the notification dated October 10, 2023, and further extended by notification dated March 15, 2025, and September 27, 2024, is unconstitutional, ultra vires, unjust, unfair and bad in law. The union has thus urged the court to quash and set aside the ESMA.

The High Court has issued notice to the government with the hearing likely on February 3.
