HC rejects plea challenging GMC physio's selection

The Bombay High Court at Goa has rejected a petition filed by one Preeti Lotlikar who had sought to challenge the selection of Antonya Pereira for the post of physiotherapist in Goa Medical College. 

Lotlikar, who had also applied for the post but was not selected, had approached the court challenging the recruitment process.

The High Court bench of Justices M S Sonak and Bharat Deshpande said they were “not convinced” by the petitioners claims that she should have been accorded more marks than the successful candidate or that there were flaws in the recruitment process. 

“Though no specific criteria were adopted by the Selection Committee, it cannot be said that only because the petitioner got a higher percentage at the degree level, she would have been given higher marks than the other candidates who got less marks,” the Bombay High Court said in the judgement authored by Justice Deshpande. 

“The criteria for granting marks were evaluated by the Selection Committee and it was published on the website before conducting such a process. The candidates cannot claim right over the procedure adopted by the previous selection committee and more specifically, the marking pattern,” the High Court said. 

“These marks were allotted on the basis of the procedure which was adopted and declared much prior to the verification of documents and skill test. There is no illegality or arbitrariness found as claimed by the petitioner,” the Court also said.
