State invokes ESMA to deter pharma workers from strike

Anticipating strike from pharmaceutical workers, the State government has invoked Goa Essential Services Maintenance Act, 1988 prohibiting the employees of this sector from striking work.

An order issued by Under Secretary (Home-I) Vivek Naik, on June 16 has declared manufacturing, packaging, distribution and transportation of pharmaceutical products and components sector to be an essential service for ESMA. 

“In exercise of the powers conferred by sub-clause (v) of clause (a) of sub-section (1) of section 2 of the Goa Essential Services Maintenance Act, 1988…, the Government of Goa being of opinion that strikes in manufacturing, packaging, distribution and transportation of pharmaceutical products and components thereof, would prejudicially affect the maintenance of supplies and services necessary for the life of the community”, the order reads.

The order further states that “any strike would result in the infliction of grave hardship on the community, and hereby declares the sector of manufacturing, packaging, distribution and transportation of pharmaceutical products and components thereof to be an essential service for the purposes of the said Act”.
