In a setback to Goa Police conducting a probe into the defacement of public property against the Aam Aadmi Party (AAP), the Pernem police on Wednesday submitted to the High Court of Bombay at Goa about withdrawing the summons notice to Delhi Chief Minister Arvind Kejriwal.
The submission comes in response to a petition filed by Kejriwal seeking to quash the notice that directed him to appear for questioning on April 27 in connection with the matter that occurred in the run-up to the Assembly elections in 2022. The AAP founder also challenged the police action citing he is nowhere named in the First Information Report.
When the matter came up before the division bench on Wednesday, the government stated they are withdrawing the notice. After issuing him a notice this month, Kejriwal said he will “definitely” go and join the investigation days after which he challenged it before the High Court.
The notice under section 41 (A) of CrPC, stated that during the investigation of a First Information Report registered under Section 188 of the Indian Penal Code and Section 3 (penalty for defacement of property) of the Goa Prevention of Defacement of Property (GPDP) Act, lodged at Pernem police station in Goa, it was found that “there are reasonable grounds to question you to ascertain facts and circumstances from you, in relation to the present investigation”. “Hence you are directed to appear before me on April 27 at 11 am at Pernem police station."
