The Supreme Court delivered an important judgement that when a drawer signs a cheque and gives it to be filled by any other person, the drawer cannot deny his liability towards payee on the ground that he didn't write it as per Case No LiveLaw SC 714 CrA 1260 of 2022 dt 16/08/2022.
As per British Law and Practice of Banking, it was decided that if a drawer issues a cheque to the payee and the drawer dies, the law there says the cheque must be honoured by the bank as the drawer's intentions were to pay the amount to the payee before his death. But in our country it is not the case.
