The Panaji city's internal roads have been dug up for various Smart City projects and are in a dilapidated condition, providing no solace for motorists and commuters taking the internal roads to escape the traffic on the main road. Poorly maintained roadways cause accidents in a variety of ways, mostly due to the fact that they create an enormous hazard to drivers. In many instances, a driver may attempt to avoid a certain situation, like a pothole or pool of water which could cause a serious accident. Even a sudden bump in a pothole can cause acute spinal injuries like slipped disc and vertebral fractures. Vehicles, too, take a hit on bad roads. Components like shock absorbers, suspension and tyres can be damaged due to driving on potholed and battered roads. It is a big financial burden. Who is liable? It is indeed the duty of the government and the public authority responsible for maintaining roads. Various laws, principles and doctrines could be evoked and brought in force to prove the negligence.
