Justice M Nagaprassana of the Karnataka High Court said, “The petitioner laments his personal liberty was torn into smithereens by a few megalomaniac policemen.” Retired Justice RS Sodi is of the opinion that judges appointing themselves is unconstitutional and the law secretary wants the government to have a say in selection of judges.
The police are subservient to the executive, the government is trying to overpower the judges and the judges are not transparent in making appointments.This is a sorry state of affairs? All however agree that the system needs change! The police cannot be “caged parrots” of the executive and the Parliament and Judiciary equally important must recognize that the Constitution is supreme. All have to function as laid down in the Constitution with transparency and accountability to “We The People” who seem to be left out in the cold by those they elect!
The answer is the highest authorities must sit down and work out a fool proof system with representatives of judiciary, legislature, executive and also a neutral representative of the people in the Committee. The whole world is in turmoil and looking at us during these difficult, uncertain and dangerous days. We have to rise to the occasion and not let humanity down!
