NO-CONFIDENCE PUNCH

The SUMUL effect was apparent in the no-confidence motion, as the directors accused Desai of being more interested in his post rather than tackling SUMUL\'s significant inroads in Goa Dairy\'s territory.
It may be recalled that on May 18, the meeting convened to discuss the no-confidence motion concluded without any discussion. During the meeting, Baburao Desai submitted a copy of the SC judgement to the presiding officer (assistant Registrar) Anil Desai stating that no-confidence motion cannot be moved within two years of a person taking charge.
Anil\'s act was challenged in the high court by nine directors against Baburao Desai. After hearing, the court directed to convene a fresh meeting to discuss the no-confidence motion.
Accordingly, Anil Desai convened a fresh meeting on Wednesday and informed that Baburao Desai lost in the voting held by raising of hands.
“Nine directors raised their hands to unseat Baburao Desai. One director was absent and another remained neutral,” Anil Desai said. Co-operative officer Harish Naik assisted him.
Former chairman Vithoba Desai, Madhav Sahakari, Shrikant Naik, Dhananjay Desai, Naresh Malik, Ulhas Sinari, Rajendra Sawal, Gurudas Parab and Shivanand Pednekar voted to pass the motion, while Madhav Rao Desai stood neutral. Baburao Desai voted against the motion.
When asked why he had concluded the last meeting without any discussion, Anil Desai said he respected the judgement of the Apex court. “It was a peculiar case in front of me. So I decided to respect the Supreme Court,” he said.
To a question what made him to reconvene the meeting, he said: “After High Court’s direction, I have convened this fresh meeting as per Sec-59-A of Goa Cooperative Societies Act.”
Baburao Desai was elected as chairman on October 14, 2015, and no-confidence motion was moved on April 29.
Sources informed that the judgement of SC is not applicable in Goa, as Goa Cooperative Societies Act is different and no-confidence motion cannot be moved within six months of a person taking charge.
When asked whether he admits his mistake of concluding meeting without discussion, Anil Desai said it was not a mistake, but respect to Supreme Court.
Madhav Sahkari said Baburao Desai failed to tackle the rival ‘SUMUL’ milk producer and didn’t take any step to persuade farmers leaving Goa Dairy. “He failed in all aspects. Hence, we wanted to oust him.”
Speaking to media persons, Baburao Desai said he felt that he should get justice and will take legal advice over recent development. “I am not happy with this. I will take legal advice,” he added.
When asked if he had retained the seat by showing SC judgement in a situation when all are against him, how he would have performed, he refused to reply. But when asked whether he will support the new chairman, he said: “I will think over it.”
