A Judicial Magistrate First Class (JMFC) Court at Mapusa has issued a non-bailable warrant (NBW) against city-based builder Vijay Deshmukh after convicting him in a cheque dishonour case under the Negotiable Instruments Act, 1881.

Judicial Magistrate First Class Sunita Gaunekar held Deshmukh, proprietor of Deshmukh Constructions, guilty of the offence punishable under Section 138 of the Negotiable Instruments Act and convicted him under Section 255(2) of the Code of Criminal Procedure.  

The court had sentenced Deshmukh to one year of simple imprisonment and directed him to pay compensation of Rs 1 crore to the complainant, Rui Da Gama. In the event of failure to pay the compensation, the court ordered that he undergo an additional 30 days of simple imprisonment.  

Following the conviction, the court issued a non-bailable warrant for Deshmukh’s arrest and directed the Superintendent of Police, North Goa, to execute the warrant.  

The warrant directs the police to arrest Deshmukh and produce him before the JMFC Court on or before July 29 at 10 am to undergo the sentence imposed by the court.  

Section 138 of the Negotiable Instruments Act deals with the dishonour of cheques due to insufficient funds or when the amount exceeds the arrangement made with the bank. Upon conviction, courts may impose imprisonment, monetary compensation, or both, depending on the facts of the case.
