The Goa government filed a disobedience petition before the Mahadayi Interstate Water Disputes Tribunal claiming that the government of Karnataka has been diverting water from the Mhadei basin in violation of an injunction granted by the Tribunal.
Advocate General Dattaprasad Lawande confirmed that the petition order 39 Rule 2A of Civil Procedure Code was filed before the Tribunal at New Delhi on Monday.
The Goa government has consistently claimed that Karnataka has violated an injunction imposed by the Tribunal disallowing the diversion of any water by Karnataka until the final award was granted by the Tribunal.
Tribunal was then notified on the intervention of Supreme Court and Karnataka was directed in August 2008 not to divert or utilize the waters of Mhadei river during the pendency of the hearings. The Government of Goa then had filed Interlocutory application in 2012 on constitution of Mahadayi Water Disputes Tribunal requesting for stoppage for Kalsa diversion works before the Supreme Court in February 2012. The Tribunal vide its order dated 17/04/2014 directed Karnataka not to actually utilize or divert the water under Kalsa Bhandura project till the disputes arising between the three States are finally adjudicated by the Tribunal.
Goa accused Karnataka of violating this direction.
Government had filed Original Suit in Supreme Court in 2006 for appointment of Tribunal as well as stoppage of works. On request of State of Goa, Tribunal directed Government of Karnataka to block the vents of the conduit to prevent any waters from Kalasa nallah to flow in Malaprabha river. The blocking was supervised by Superintending Engineers of all the three participating States.
Earlier the Government of Goa filed Interlocutory Application on 19/01/2018 before the Tribunal as State of Karnataka has commenced the Kalsa diversion work and blocked the open channel by blocking the water from flowing to Goa in Kalasa nalla.
The Goa government has also said that Karnataka would require to file DPRs and get permissions from either the Union Government or a Mahadayi Water Management Authority which Goa wants set up to implement the ruling of the Tribunal from before they can claim their share as awarded by the Tribunal.
