CJM Margao issues summons to 3 accused on bail

A day after the Fatorda police filed the 624-page chargesheet in the Mungul gang war case, the Chief Judicial Magistrate First Class, Margao, Judge Shubada Dalvi on Tuesday took cognisance of the chargesheet and the presence of the accused person via video conferencing.
The court, however, has issued summons to the three of the 28 accused persons, who were released on bail for appearance before the court at the next date of hearing.
Taking cognisance of the chargesheet filed by the court, the CJM took the cognisance of the accused persons via video conferencing. While the Fatorda police has filed the chargesheet against all the 28 accused persons for their alleged involvement in the case, 25 of the accused are still in judicial custody, while three have been enlarged on bail.
In the 624-page chargesheet, the Fatorda police has alleged that the accused persons had hatched a “pre-arranged plan” to assault one Walter Fernandes in the wee hours of August 12 last.
In support of its case, the Fatorda police has cited around 84 witnesses. The chargesheet stated that in furtherance to the pre-arranged plan to assault Walter, the accused formed an unlawful assembly and armed themselves with deadly weapons viz. filled soda bottles, iron rods, hammers, choppers, swords, knives, axe and a firearm.
Believing that Walter Fernandes was travelling in the Baleno car owned by the complainant, Yuvkesh Singh Badaila, the accused persons A-1 to A-25 wrongfully restrained the vehicle in front of Bab Bakery, near Sagun Restaurant, Mungul, Fatorda, Salcete, Goa, using White Toyota Innova, a white Maruti Suzuki Fronx and a red Maruti Suzuki XL6.
All the 28 accused persons have been charged for committing offences punishable under Section 109, 111, 115(2), 118(1), 118(2), 126(2), 324(4), 351(3), 61(2), 241, 249(B) r/w 190 of BNS, 2023 and Sections 3, 4 r/w 25 of the Arms Act, 1959.
