New Act eliminates construction licence for shacks, mandates restoration of sites

PANAJI
The government on Thursday notified The Goa Erection of Shacks on Public Beaches (Regulation and Control) Act, 2024, which introduces comprehensive regulations for the construction and operation of temporary and seasonal structures on public beaches.

The Act supersedes requirements from earlier statutes, eliminating the need for a construction licence or technical clearance for shacks and similar structures.

“Notwithstanding anything contained in The Goa Town and Country Planning Act, 1974, the Goa (Regulation of Land Development and Building Construction) Act, the Goa (Regulation of Land Development and Building Construction) Act, 2008, the Goa Panchayat Raj Act or any other State law for the time being in force, or order, judgment or decree of the Court, the erection and operation of the beach shacks on the beach site under the Goa Shack Policy and the temporary and seasonal structures permitted by the GCZMA shall not require any construction licence or a technical clearance under any of the foregoing statutes,” the notification said.

Instead, operators must secure permission to erect a temporary and seasonal structure from the Director of Tourism, No Objection Certificate and trade licence from the Panchayat or Municipality or City Corporation of Panaji, within whose jurisdiction the shack or temporary and seasonal structure is being erected, NOCs from concerned Health Officer, Directorate of Fire & Emergency Services, and excise licence.

The notification further states that for temporary and seasonal structures other than the beach shacks permitted by the Tourism Department, coverage of a plot shall not exceed 33 per cent of the total plot area.

It also states that beach shacks must be dismantled on or before June 10 and the beach site be restored to its original condition each year. For delay, the allottee will be liable to pay a penalty of Rs 5,000 per day to the department.
