The Sessions Court of North Goa imposed a fine of Rs one lakh on a German national after he was convicted of being in illegal possession of charas and MDMA worth Rs 50,000.
Peter Selchow, who was residing at Arambol in Pernem was arrested by Pernem Police on February 14, 2011 at around 10.30 am at Khalchawada in Arambol for being in illegal possession of 37.650 gms of charas and 8.321 gms of MDMA.
The accused pleaded guilty and did not wish to lead any evidence before the court after he was booked under Section 20 (b) (ii) (A) of Narcotic Drugs and Psychotropic Substances Act, 1985.
During the course of trial, the accused Selchow met with an accident and his left side was paralysed permanently. This issue was formally brought before the court by a representative of the Consul of Federal Republic of Germany in Goa, Dean W Menezes. In a letter addressed to the Sessions Judge, the German Consulate informed that the accused is a German national and a native of Hamburg.
As per the letter, Selchow met with an accident in Pernem and suffered grievous head injuries. He was immediately admitted to Goa Medical College and Hospital, Bambolim.
He then had a brain stroke which resulted in paralysis of his left side.
The letter informed that though he has been discharged from the hospital, Selchow cannot walk and that his friends are taking care of him in Arambol while his friends back in Germany are preparing to arrange for the finance to take him back to Germany.
The Consulate stated before the court that it would like to send Selchow back to Germany as soon as possible for further treatment as his condition was not stable, a fact which was proved through the medical report dated January 10, 2017.
Considering his health, the investigating officer also refrained from raising any objections.
The Court decided that the period of imprisonment already undergone by the accused shall be considered as appropriate sentence while also imposing the fine of Rs one lakh.
Following his arrest, Selchow was remanded to seven days custody. The period of seven days custody was set off against his sentence by the Court.
