Alleging that the appointment of a differently-abled Motor Vehicle Inspector is illegal, Sudip Tamankar, an office-bearer of a transporters association and an RTI activist has filed a complaint before the Anti-Corruption Bureau of the Vigilance department.
Tamankar has sought registration of an FIR against the concerned minister and officials responsible for the alleged illegal appointment under sections 109, 114, 409, 467, 468, 471 and 120 (B) of IPC and section 13(1)(d) read with section 13(2) of the Prevention of Corruption Act, 1988.
Tamankar alleged the assistant director (Welfare of Disabled), Directorate of Social Welfare had granted approval for de-reservation of one post of Assistant Motor Vehicle inspector (AMVI) following which the post was advertised in the General Category and filled by appointing one Pramod Shet.
The de-reservation was challenged by Nigel Karl Lournco before the Commissioner for Persons with Disabilities who thereafter directed the transport department to appoint the petitioner to the post of AMVI.
The Disability Commissioner had also directed that the appointment of Pramod Shet be terminated if a post is not available or a supernumerary post be created.
Though the transport department attempted to challenge the Disability Commissioner’s order, it withdrew the challenge on January 18, 2018 at the stage of final hearing and appointed Nigel Karl to the post of AMVI.
Tamhankar’s complaint alleges that Nigel Karl was appointed to the AMVI although he never applied for the post and without the process of advertising the post for physically-disabled persons. Tamhankar also questions in the complaint the validity of certificates produced by Nigel Karl at the time of his appointment as AMVI.
