An independent opinion offering ‘impressions’ on the two post mortem reports by an unnamed forensic expert and released by a group of ‘concerned citizens’ has said that the second medico legal autopsy was methodically, thoroughly and competently performed but that neither of the reports so far have ruled out murder of Bismarque Dias.
The opinion, which also questioned the first post mortem report for its serious deficiencies, was released by Samir Kelekar, an activist who said he submitted the reports to the independent forensics professional for his opinion and received the report only recently.
Referring to the report of the viscera which was examined by the Central Forensic Science Laboratory, the opinion has found that it has remained silent on how much alcohol was consumed and how long before he allegedly went swimming raising questions as to whether the request form had specific requests to the laboratory.
The opinion also has stated that while the diatom report confirms that Bismarque was alive at the time of immersion and the place where he dies, it does not clarify the circumstances of death.
“It is clear that the post mortem report does not rule out murder and has instead said that while Bismarque has drowned, the circumstances of his drowning have to be investigated by the police. The police are using this to rule out murder,” Kelekar told the media.
He said the group was demanding the registering of an FIR under section 302 (murder) of the Indian Penal Code and taking the investigation forward from there.
The opinion offered by the unnamed forensic expert has said that a person can be rendered unconscious even if there are no obvious external or internal injuries especially when a cosh is used to inflict the blow resulting in a concussion resulting in physiological disruption of brain function without any visible organic injury -- the damage is at a microscopic level to the neurons and axons.
The opinion was very critical of the first post mortem report which it said among other deficiencies, didn’t preserve blood from large vessels, urine from the bladder had inadequate descriptions of the injuries, state of clothing, etc. The group has said they have submitted the opinion to the police and are awaiting the police reaction to the same.
