In a setback for prisoners seeking medical examination outside the jail premises, the High Court of Bombay at Goa directed that they must undergo a medical check-up by the existing in-house doctor.
The High Court is hearing a writ petition filed by six inmates who alleged constant bullying and harassment by certain jail officials following a fight between two groups led by Vijay Karbotkar and Tarzan Parsekar within the jail premises on May 30. The injured inmates sought medical treatment at a hospital outside Colvale Jail.
During the hearing on Wednesday, the Bench denied the plea, stating that prisoners should only be taken out of jail if “absolutely necessary”.
Advocate General, Devidas Pangam assured the Court that the prisoners’ medical reports would be submitted in the next hearing, a submission which was accepted by the Bench.
Regarding the allegations of assault on prisoners by jail officials, the AG stated that an affidavit explaining the sequence of events leading to the fight will be filed by the next date of hearing. The Court adjourned the matter for June 28.
Six inmates Sameer Shaikh, Kurban Shaikh, Ismael Mulla, Sadik Bellary, Mustafa Shaikh, and Mohd Sharif Shaikh claimed that a senior officer had shoved a pistol into the mouth of one of the inmates to intimidate him, a day after the violence between the two factions.
