The Verna police has prayed to the South Goa Sessions Court to reject the anticipatory bail application filed by former MLA Mickky Pacheco, saying the applicant is required in police custody for the purpose of investigation in the Utorda incident.

In the reply filed in the court of Additional Sessions Judge Sayonara Laad on Friday, the Verna police said Mickky is required in police custody to collect more evidence and to find out the identity of his accomplice accused persons involved in the case. “Mickky’s custodial interrogation is very much necessary since the three unknown accused are only known to the applicant as they were accompanying him on the day of the incident,” the Verna police stated in its reply to Mickky’s anticipatory bail application.

The police submitted that the offence committed by the applicant along with three more unknown persons with their common intention is of serious nature and has created fright and fear in the mind of the complainant and her other family members including her son Franky Melroy Da Silva, who had recorded the incident on his mobile. The police said the act of the applicant has created fear in the mind of the public as he is an ex-MLA, adding that confidence needs to be built in the minds of witnesses so that they come forward without fear to give their statement.

In another development, the complainant Fanny Da Silva moved an application before the Court to make her an intervenor in Mickky’s bail plea, which was later granted.

Mickky’s lawyer, Byron Rodrigues said he would file his reply in the case as arguments will take place in the court on Saturday.
