Undeterred after its earlier order of dissolving the entire managing committee of the Comunidade Fraternal de Aldona came under legal scrutiny, the State government has gone ahead and once again dismissed the attorney of the comunidade and ordered an inquiry on its president and treasurer.
Revenue Minister Atanasio (Babush) Monserrate has upheld the earlier proposal of the Administrator of Comunidades for North and passed an order dismissing attorney Tome Sequeira.
The minister has further directed the administrator to conduct an inquiry by hearing the other members of the committee “ the President and Treasurer “ and submit the report within eight days.
Interestingly, Tome Sequeira has ceased to be the attorney of the Comunidade Fraternal de Aldona as a new managing committee has been elected last Sunday.
Relying on the report of the administrator, Monserrate in his order said that the administrator’s report concluded that the present and the past managing committees were involved in passing unlawful resolutions to compromise a civil suit.
He said the attorney was given a hearing and later suspended by the administrator and therefore should be dismissed by the government.
He further said that the administrator did not specify whether the other members of the committee were involved in illegal acts.
“Since no inquiry is conducted against the other members by offering an opportunity of hearing except the attorney, this authority is not inclined to dissolve the entire committee,” Monserrate said in his order.
It may be recalled that the State government had dismissed the president and the attorney and also dissolved all the elected members of the managing committee of the Comunidade Fraternal de Aldona in August last year, ostensibly for failing to act upon illegalities and defend the interest of the comunidade.
Acting on a complaint filed by a section of the components of the Comunidade Fraternal de Aldona, the Administrator had proposed the dismissal of the president under Article 125 (13) and suspension of the attorney under Article 74 of the Code of Comunidades.
But after the managing committee took a legal route to challenge the government order, the Bombay High Court at Goa quashed the order of the government dissolving the managing committee and the resultant order of the Administrator in taking over the management of the comunidade.
