Special Investigation Team (Mining) of Goa Police which is probing the alleged Rs 35,000 crore illegal mining scam has recorded the statement of former Mines Secretary J K Dadu with the aim of proving that former Mines Minister and Chief Minister Digambar Kamat allegedly bypassed Dadu's notings opposing the illegal condonation of delay in renewal of around 40 mining leases.
Previously, former principal mines secretary Rajiv Yaduvanshi had sought to defend his unauthorized condonation of the delay in renewal of around 40 mining leases during his tenure at the behest of Kamat.
Yaduvanshi has stated that he was misguided by Kamat, who allegedly pointed at a wrong precedent while instructing Yaduvanshi to follow the unauthorized manner of condoning the delay.
As per the Mines and Minerals (Development & Regulation) Act, 1957, the application for renewal of a mining lease has to be moved at least a year in advance.
In 2006, one Anthony D'Souza moved a mining lease renewal application, which was rejected by then principal mines secretary J K Dadu on these grounds.
However, this application file was then placed before the then mines director J B Bhingui, who bypassed the principal mines secretary in moving the file before the then mines minister Kamat with the recommendation for renewal. Accordingly, Kamat granted the renewal.
In his statement, Yaduvanshi has claimed that in 2007 when he assumed the office of principal mines secretary, then CM and mines minister Kamat gave the example of D'Souza's mining lease renewal while instructing
him to follow the wrong procedure in condoning delays in seeking renewal in over 40 mining leases.
