Judicial Magistrate First Class, Vasco has directed Vasco Police to book the maternal uncle of two young girls from Vasco for trespassing into their guardian's house, criminal intimidation, kidnapping and child abuse.
As per the complaint submitted by the grandmother of the two young girls, the uncle, a resident of Gwalior, Madhya Pradesh, trespassed into her house and threatened her and her two granddaughters aged 13 and 7 years with dire consequences. He then allegedly attempted to kidnap one of the girls from the lawful guardianship of the grandmother.
As the Vasco Police failed to register an FIR against the uncle, the grandmother approached the court seeking direction to the police.
Defence counsel Savio Noronha relied on Supreme Court judgments to argue that when a complaint discloses a cognizable offence, it is the duty of the investigating officer to register an offence.
Adv Noronha also drew the court's attention to the application filed by the grandmother on October 10, 2017 before the Superintendent of Police, South seeking police protection fearing danger to the lives and safety of the children.
On November 10, 2017, by an interim order, the Civil Judge Senior Division at Vasco had appointed the grandmother as the guardian of the minor children.
Following the court's direction, the uncle has now been booked under Section 448 (house trespass), 506 (criminal intimidation), 363 (kidnapping) and 511 of IPC along with Section 8 (child abuse) of Goa Children's Act, 2003.
In its order, JMFC Vasco has also directed that the investigation be completed within a period of one month by filing a final report before competent authority.
It may be recalled that the sister of the accused -the mother of the girls -was booked along with her paramour by Vasco Police in October 2017 on charges of molesting, abusing and assaulting one of the minor girls. The partner, on his visits home, allegedly touched the child and hugged her inappropriately. The girl narrated the matter to her grandmother when she found her crying profusely late in the night.
The mother and her paramour were booked under Sections 509 (word, gesture or act intended to insult the modesty of a woman), 354 (Assault or criminal force to woman with intent to outrage her modesty), 354-A (sexual harassment), 354-D (stalking) , 324 (voluntarily causing hurt by dangerous weapons or means), 506 (criminal intimidation) read with 34 of IPC and Sections 8, 11 and 12 of the Protection of Children from Sexual Offences Act.
