In a surprising turn of events, three out of the four persons who furnished sureties for the notorious history-sheeter Tarzan Parsekar expressed their inability to produce the absconding accused before the Bombay High Court at Goa. The fourth surety initially agreed to do so but failed to meet the deadline set by the Court.
The Bench of Justice Bharat Deshpande had last week directed trial courts to issue notices to those who furnished sureties for bail for Parsekar, who has absconded since his bail was cancelled in a pending criminal case.
During the hearing on Wednesday, the Bench was informed about the development after which the Court forfeited surety amounts. The record also showed that the accused did not appear in all four case trials before the respective courts.
“Similarly, an attempt was made to serve the Respondent, however, a report was received that he is not residing at the said address and was not found for the purpose of service of notice,” the Bench observed.
While adjourning the matter for final disposal on August 27, the Bench has directed the Member Secretary Legal Services Authority to appoint an Advocate from the legal aid panel to represent the accused before this Court by Friday.
The Bench was hearing a suo motu criminal revision based on the Supreme Court’s order on May 15, 2024, in a Special Leave Petition (Criminal) wherein it requested the High Court to suo motu examine the legality and propriety of an anticipatory bail granted to Parsekar by the Children’s Court, even after some material facts were noted.
