5 get RI in Margao dacoity case of 2015

The South Goa Sessions Court has sentenced all five persons charged in the 2015 Margao dacoity to five year rigorous imprisonment. 

Additional Sessions Judge Sayonara Telles Laad sentenced Kumar Bijapur, Hamid Bepari, Basuraj Jamuni, Babu Marathe and Sameer Bepari to five years rigorous imprisonment. Each of the accused persons were further ordered to pay a fine of Rs 5000 and in default to pay the fine amount to undergo simple imprisonment of 15 days. 

Public Prosecutor V G Costa informed that the court has ordered that the imprisonment already undergone by the accused persons will be set off.  In this case, the five persons were charged of committing dacoity of a native of Karnataka at the Marrgao station road when they were heading to the Margao railway station to board a train to their native state.   

Though section 395 of the IPC is punishable with imprisonment for life or rigorous imprisonment for a term which may extend to 10 years and shall also be liable to fine, Judge Sayonara Telles Laad said she is of the view that awarding the accused sentence of imprisonment for life is not called for as in the facts of the case nor sentence of 10 years is called for. 

“However, I am of the view that rigorous imprisonment for a period of five years and fine would be just and reasonable to meet the ends of justice,” the Judge observed.
