After MMC setback, RERA tells builder to register project or pay penalty

Close on the heels of Mapusa Municipal Council revoking occupancy certificate issued to Prabhu Chambers, a multi-storeyed construction in Mapusa, the Real Estate Regulatory Authority (RERA) has now directed Venkatesh Prabhu Moni of M/s Prabhu Constructions to register the controversial project under RERA or pay Rs 3 lakh penalty.

Interim Authority of Goa RERA, Puneet Kumar Goel, IAS, directed the builder Venkatesh Prabhu Moni to register the Prabhu Chambers project under RERA by September 30 or pay the penalty.

“It has been decided to impose a penalty of Rs 3 lakh if the project is not registered under RERA by September 30. Delay in registration would lead to further penalty,” Goel said in his order.

Goel had recently conducted a hearing after receiving a complaint from one S L Raut.

In his complaint, Raut said that he had booked a unit in the project named Prabhu Chambers near Milagres Church, Mapusa, and entered into an agreement for construction-cum-sale on June 7, 2013.

The interim authority of Goa RERA has also said that two-third of the allottees were willing to form a society to take the project under their wings.

The Mapusa Municipal Council Chief Officer, Clen Madeira, had revoked part occupancy issued to Prabhu Chambers, a six-floor construction in the city, on September 12, after some persons who have booked units in the building filed a complaint against the irregularities committed by the builder.

Mapusa Police has also filed an FIR against the builder under Section 420 (cheating) and 336 (endangering lives).

In the meanwhile, some of the aggrieved persons who have booked units in the controversial project slammed the local civic body and the North Goa Planning Development Authority for granting completion certificate for the construction.

“The mother of all problems in the project is the collection and retention of water in the basement of the building. There is always water in the basement even during the summer. The electricity department has refused to issue power connection and the building does not have an adequate parking facility,” alleged Jitesh Kamat who has booked a unit in the building.

He said as per law every construction that was not completed by March 23, 2018, had to be registered under RERA but this particular project wasn’t registered under the new Act.

RERA is a law for regulation and promotion of the real estate sector to ensure the sale of apartment, plot or building efficiently and in a transparent manner and seeks to protect homebuyers from unethical builders.

Kamat appealed with the Goa RERA to take over the building and complete the project so that people who invested in the project get justice.

Some other owners of units in the project have also made several allegations against the builder for making false promises and deceiving them.

MMC CO’s decision challenged
MAPUSA: The Mapusa Chief Officer’s order to revoke the occupancy certificate of the controversial building, Prabhu Chambers, has been challenged before the Urban Development Minister Milind Naik.
Sources informed that the beleaguered builder has appealed against the order before the urban development minister who is the appellate authority in the case.
“The minister has already conducted a hearing on the matter and a decision is expected soon,” sources said.
