All three accused were admitted at the casualty ward of Goa Medical College and Hospital, Bambolim on Wednesday night. Phadke and Desai were admitted at around 10 pm with high blood pressure and Mulla was admitted shortly after he complained of severe headache and uneasiness by around 11.30 pm.Phadke and Desai were produced before the JMFC on Thursday but Mulla continues to remain at GMC.
In their remand application, the police sought seven days police custody citing various grounds, the most prominent of which include recovery of managing committee minute book of GCA, recovery of the allegedly misappropriated money, requirement of understanding the details of cheque withdrawal and to identify the person who withdrew the cash.
Police also cited the need to verify the possibility of involvement of more people in the alleged conspiracy.
In addition to this, week-long custody was also sought for verification of the identity of one ‘Rajshekhar’, in whose name two bearer cheques made out to Hako Engineering, a Mumbai-based company, were issued. Police also sought to inform the Court that the accused are not cooperating with the probe.
Arguing the case, legal counsel of the three accused countered the remand application stating that recovery of the managing committee minutes book cannot be a ground for remand.
Speaking to the media, Adv Abhijeet Kamat stated, “During the investigation, we have already produced a letter from the previous GCA president Dr Shekhar Salkar stating that the minute book was stolen from his car in 2015 and hence, the same cannot be submitted to the investigating team.”
He informed that Dr Salkar had also lodged a police complaint after the book was stolen from his car parked outside a hospital, where he had stopped en route to GCA office to hand the book over.
Desai and Phadke were moved to Panaji Town police station lock up in Police Headquarters premises on Thursday evening and all three accused are
expected to be produced again before the JMFC on Friday for remand.
