The High Court of Bombay at Goa has disposed of a petition concerning the welfare of two minor children after the Child Welfare Committee (CWC) informed the court that both children were happy, attending school regularly, and cooperating with officials as per the court’s earlier directions.
A Division Bench of Justice Neela Gokhale and Justice Amit Jamsandekar closed the proceedings after recording the mother’s assurance that she would continue to cooperate with the CWC by producing the children for interaction whenever required and allowing officials to meet them at both the committee’s office and their residence.
The High Court had earlier expressed concern over the children’s welfare following allegations of domestic abuse against their father. The minors were rescued and kept at Apna Ghar before being handed back to their mother, who had assured the court that she would cooperate with the CWC’s monitoring process.
The matter came up again after the CWC reported that the children had not been produced before it and that its officials were not allowed to meet them at their residence. Taking note of the non-compliance, the High Court had directed the mother to strictly follow its earlier orders.
During the latest hearing, the petitioner’s counsel informed the Bench that the mother had complied with the order dated July 16 by bringing both children to the CWC office for interaction.
The counsel also submitted that there had been “some misunderstanding” when CWC officials had earlier visited the residence, but the issue had since been resolved.
In its report submitted to the High Court after interacting with the children, the CWC stated that both minors appeared happy and were attending school regularly, indicating that their immediate welfare was not a concern.
The mother, through her counsel, assured the court that she would continue to bring the children before the CWC whenever required and allow officials to meet them at the office and residence as directed earlier.
Recording the assurances and taking note of the CWC’s report, the High Court disposed of the petition.
